Rule 13 Stormwater Control Compliance & Fee

Score another one for Garner the Gabber who once again duped us into believing him as he assurred everyone that the rates wouldn't rise if they let him do what he wanted. That was to institute a Stormwater fee at the beginning of the year for a mandate that didn't kick in until May, and for which no actual "project" is/was even planned.
That's the way it had to be, he said, to hold interim rates low for the first year.
Well, guess what? ...and I quote: "Things changed."
An increase in the fee was requested and passed within 5 months.
We are greatly concerned about the proposal that has been presented to Council for the creation of a new & seperate Stormwater Board that will drive the cost of meeting the Federal mandate up by more than 400 percent. A cost that rate-payers alone must bear the brunt of since there are no Federal dollars allocated to go along with the new requirement.
However, a seperate Board is neither a requirement, nor a necessity, to comply with Rule 13, but it is being sought none-the-less. We have good reason to suspect the primary motivation is the additional salary it would provide to the Mayor as Chair of the Board, but we are also aware of the plans to 'grow' this fund into a virtual garden variety of eligible costs.
There has been talk since last year that this new Stormwater "user fee" would be used to pay the Drainage Committee and any of their projects since the Sewer fund can no longer afford to bear that cost.
Now, doesn't it make sense to go ahead and put the Stormwater requirements in with the Drainage Committee that already exists and will be getting paid with this fee??? OF COURSE IT DOES!!!
The other thing Garner wants to get out of this is to start bringing the Sewer billing functions back 'in-house' which we feel is a huge mistake and another bad decision that will only hurt us in the long run.
Indiana-American Water Corp., which now handles the billing, is already set up and handling our billing needs efficiently. It is the City that has fallen off track from collecting hundreds of thousands of dollars in delinquent and unpaid sewage accounts.
In our opinion, the City simply cannot, and actually should not, perform the functions of a private bill collector.
As someone stated just recently..."we have enough on our plates."

  • When I told my husband they had the "PUBLIC HEARING" for the Scribner project based on his property taxes at 1:30 in the afternoon yesterday, I just had to laugh with his response to same.

    He said to tell the Mayor he might as well have held it at 2:00 AM, it is that blatant to the people who are working to pay those property taxes indicating their input just WAS NOT NECESSARY.

    As I told him, hey, try making Flood Control Meetings at 9 AM on Mondays, or Board of Works at 10:00 AM, or the Sewer Board at 3:30 PM. How many of the public CAN TAKE OFF FROM WORK and deal with these issues (ALL THE TIME, BECAUSE IT NEVER STOPS WITH THIS ADMINISTRATION). There is always something important up on an agenda WE ALL NEED TO KNOW ABOUT.

    If it wasn't for our Council person being able to attend some of these meetings, and another one faithfully attending (both for citizens and for their own knowledge of events) -- we wouldn't know what the hey was going on MOST OF THE TIME.

    Our family thanks those that CAN ATTEND THOSE MEETINGS and lets us know what is going on. Thank you, thank you, thank you. It can't be easy, nor convenient for all of you either. We realize that, and appreciate it.

  • Well, well, well. As my Geography teacher use to say when I started a sentence with that word -- "well is a pretty deep subject".

    So, according to the articles in the CJ, Overton is saying Garner voted against this Plan. Yes, he did because he did not think the Plan would work, and it didn't. This may be a part she should have added in for clarity of the subject.

    Where it falls down for us is, if the now Mayor didn't think it would work, why is he so vigorously defending it and fighting with the EPA over it?

    He could easily have stuck with his original intent and told the EPA he didn't sign the contracts, he this and he that. That is not what he chose to do. We feel the "heat" is on too much for him to actually do the right thing, and you have to wonder why. At least we do. The word is from Sewer Board members and Council there is anywhere from $2 million to $4 million dollars missing since he took office.

    The free-flushers are still flushing for free. Georgetown is running circles around us, back in town for an executive session yesterday. Wonder if they're changing their minds on building their new plant? Who knows -- those darn executive sessions.

    Georgetown paid us $800,000 and as far as we know, the issue was dead; even though we have two other contracts showing much larger settlements with them and lawyers suing us on top of it all.

    We will be the first to agree the Robert E. Lift station HAS TO BE FIXED IMMEDIATELY. We agree with the Engineers on the Sewer Board about this issue. What we don't agree with is this was suppose to have been fixed in 1997 (under the Agreed Order with IDEM, which BTW, is still in effect), and THIS CITY RECEIVED CREDITS FOR PROMISING TO DO THIS WORK AT THAT TIME.

    We do not feel like paying for it a second time. We have already paid for it 3 times over.

    Gear up New Albany -- and the fringe area which is paying 1 1/2 times the sewer rate, we don't even know how to let you know what is going on. It's bad enough inside the City, but the citizens in the fringe -- gear up is all we can say.

    "A lot of questions were asked that were never answered" about the costs of Scribner Place, he said at the hearing.

    He also said he believes the complex "is not going to be equitable" because some people won't be able to afford to use the YMCA." C-J 5/24/06

    That is so much baloney! Does he think every person in Louisville uses every public-supported institution? Not a chance! Does that mean we can't have anything nice and have to continue living in a crumbling, empty city with way too many dilapidated rental properties that pull down the tax base? Nice things attract other nice things. Junk attracts nore junk.

  • And if you didn't TIF every new development area, you would get those tax dollars into the General Fund. Talk to us about that one first, then we'll get to the "benefits" to the tax base, ok?

    Good reason to believe the CJ will run those articles tomorrow, as they feel they are important to the citizens as well.

  • Ground clutter there about Huckleberry. Here come the attacks. Don't worry -- we're use to 'em.

    People not allowed their opinion, even the ones who can make a 1:30 meeting over $400,000 a year for the next 20 years decision. Yeah, we understand the rationale. Too bad it doesn't fly in most of our books.

    It's called Government for the people and by the people, and we all get to have our opinions.

    What has folks most outraged is that Garner could not even mention some of the most important events leading up to this.
    He never metioned the deal with Georgetown being let go, the EPA agreed order, or the fact that the Sewer Fund has been used as the City's slush fund for...how many years now?
    They have taken so much money from Sewers to bail out so many other City Departments, including the GENERAL FUND for cash flow, and now we are expected to make all that back up with this rate increase.
    We have a real problem with the "Financials" being provided to the Sewer Board by Atttorney Greg Fifer who already has issues based on apparent conflicts of interest because he represents the Sewer Board AND all the Developers who are trying to work out deals with the Sewer Board.
    Furthermore, how are we expected to believe that suddenly they have managed to untangle the financial mess that the State couldn't untangle with their Audit, leading them to recommend a full investigational audit be performed.
    We will NOT accept this proposed rate increase without a full investigation into the financials that an outside firm has been producing for some time now.
    We wonder, why has Kay Gerry been so hands off with this one?

  • You know, we are wondering the same! If the outside CPA firm is doing the "books" for the sewer utility; Kelly in the Sewer Billing Office is taking the heat for the wrong stormwater billing; Pearline Isom is handling the benefits; WHAT IS THE CONTROLLER'S OFFICE DOING -- writing the checks? We know there's no bank recon being done -- it's in the AUDIT.

    Why didn't the Controller present the financials at that meeting? Hmmmmm. Yeah, we don't like this neither. If Garner thinks his little spiel is going to make the "bond holders" happy, he may have a rude awakening. See, we can prove those monies were to be put back for this payment; the monies are missing. And when someone earlier mentioned the $2M to $4M missing -- that is simply out of sewers, folks.

  • They also held the PUBLIC hearing on the Scribner Place Project in the middle of the afternoon yesterday, clearly slamming home the administration's conclusion that the public's opinion doesn't really matter.
    After all, a $17 million swimming pool is just what we need when we are scrambling for money to fix the sewers as mandated by the EPA and as is necessary before ANY development can take place in the City.

    The real crux of this disgareement is in the fact that the Bonds will require a $400K EDIT pledge every year for the next 17 years!!!
    We can, and will, show documents that dictated EDIT funds be used to pay for EPA mandated repairs and upgrades to the Sewer System. Now, they want to re-pledge those EDIT dollars to Scribner and turn to the rate-payers to cover the costs of repairs.
    We beg to differ.
    Then we will INSIST on a different approach if our efforts are stonewalled.
    They can build the YMCA without the swimming pools and it will not cost the City anything other than the cleanup that's already been done. A good deal for everyone.
    We feel they should wait 2 years before building the Swimming Pools so we can concentrate on fixing the infrastructure and complying with the EPA directives.
    City Attorney Shane Gibson stands to earn about $200K on the sale of these bonds, and who knows what kind of deal Garner has made.
    This is a non-profit venture that will not put any tax dollars into the City coffers, and we are sure the property has been given a tax abatement since it was donated by the City to the YMCA.
    Outside of the ASSUMED draw Scribner MIGHT have on new business enterprises in the City, this project stands to provide little benefit for the majority of New Albany citizens.
    They never had an unbiased firm conduct a Feasibility Study which would have given true projections on the possibilities of drawing additional investments into Downtown. All that talk is purely speculation.
    Again, it's time for our elected officials on the Council to make some tough decisions to protect the best interests of the citizens of New Albany, and start reining in TIF's, EDIT, and other funds that can be used to mitigate the Sewer Costs.

  • I just had to write and tell you what my family thinks about this whole situation with all the rate increases.
    We think New Albany's Mayor has a serious problem understanding basic business management techniques and financial accounting.
    We also think it's pretty awful of him to be telling the public there's not enough money when the truth is that the money was there, but it's been spent on something else and it's not there anymore.
    We can't wait to see how those financial records read.
    Thanks for keeping us all informed about where our money is going.

    GET ABOUT $200,000 FOR HIS FEE ON THE SALE OF SCRIBNER BONDS.

    IT IS VERY INTERESTING THAT HE IS NO LONGER ON THE BOARD OF WORKS BECAUSE HE DOES NOT LIVE IN THE CITY OF NEW ALBANY ANY LONGER.

    I doubt that this will do any good but I am going to give it a try.

    There are written laws and then there are unwritten laws that attempt to govern civilized society. An example of an unwritten law is, you don't shout in most public places. It is called being polite.
    One of the unwritten laws of the internet is, typing in caps is considered shouting and therefore not polite. It is considered a univeral "law" across the internet.

    You may not have been aware of this "law" when you started. I know for a fact that you were politely told this several times. You have chosen not to be polite. That is my point.

  • Mr. Stewart,

    About the only actual fact that I see in your post is about the sign in front of that fine, locally owned bookstore called Destinations. I know that the sign in question has been there way before said bookstore was opened. Anyone can go look at the sign and see that is really old and rusted. Go look, Mr. Stewart, and while you are there go on in Destinations. I am sure they have nice selection of books on etiquette. You will be helping the local economy and yourself.

    I personally think it is a nice local store but opinions will vary.

    Whatever I have ordered has been on time but results can vary.

    Exactly where did I compare Destinations Bookstore to Barnes & Noble? Are you saying we don't need a local hardware store because there is Home Depot? Also, how many tax dollars has Barnes & Noble contributed to New Albany?

    I prefer to support locally owned business. Again, opinions will vary. Some people prefer to support far away corporations that could not find New Albany even with a map.
