ALERT! ALERT! ALERT!

The Mayor has called for a special meeting for this Friday at 3:00PM regarding the Stormwater Drainage plan that was rejected by Council at last Thursday's meeting.
WE MUST APPEAR AT THIS MEETING TO VOICE OUR OBJECTION TO BRINGING THIS RESOLUTION BACK BY CM DONNIE BLEVINS FOR A NEW VOTE DUE TO HIS INTENTION TO CHANGE HIS VOTE!!!
EVERYONE CALL YOUR COUNCIL REPRESENTATIVE AND ASK THEM TO VOTE DOWN THIS RIDICULOUS REQUEST FOR $800,000 AND A THIRD SALARY FOR MAYOR GARNER. IT CAN BE DONE WITHOUT THE FEES BEING PLACED ON HOMEOWNERS, AS THE COUNTY HAS DONE, FOR THE INTERIM PERIOD.

The Council voted down the Resolution after much discussion from the Stormwater Advisory Committee which informed them that the proposed rate structure was unfair and the seperate paid 3 member board, headed by Mayor Garner thus allowing him a 3rd salary from the taxpayers of New Albany was unnecessary.

The vote was 4 against, 3 for, and 2 abstentions (Crump & Blevins).
We found it strange at the time, that the Mayor, nor the City attorney, nor the controller Kay Gerry, who is required by law to attend all Council meetings, were not present.

The time of this meeting called for on Friday will make it difficult for most people to attend due to work obligations, so we need everyone who can get there to be there.
Our friends at the Elks Lodge... we are asking for your help as well. Please come down to the meeting at 3:00 Friday afternoon, third floor, and help us reject this new fee. The Administration is asking for $800K for this project, when it only requires less than $200K be available by May of 2006.
If we do not show up in a force of numbers, they will pass this unnecessary cost on to the taxpayers of New Albany. Can you afford ANOTHER fee?

  • Good questions, both of you. The Storm Water Commitee was told the interim fee had been taken care of by Council; therefore the SWAC worked on the illicit discharge ordinance. We can't figure it out either. Anybody gets any answers, please, please, let us know.

  • Guess I'm for sure going to have to bring that grandbaby in I've been babysitting for. Hey, is there a rule against that?
    The "other" side sure has been awfully quiet, haven't they? Just reading an article from the CJ from 2001 said that says, when we were talking about stormwater then (contrary to what some people want to espouse), most areas were affected by raw sewage. HMMMMMM.
    To the old Historical Kiwanas, one time you graciously let me speak to you; and then asked what could you do to help this great City. I hope now may be a good time. Alot of people can't make this hastily called meeting on Friday at 3:00 in the City/County Bldg on the third floor. At McDonalds and Dairy Queen, come on out. Let them see the numbers; they sure aren't going to let citizens talk -- unless you call them. Thanks for letting me voice my opinion.

  • What is legal here? Councilman Blevins is an employee of the City and
    the Mayor is his boss. So-- can the Mayor use pressure on his employee to get Councilman Blevins to vote for the

  • Things is, just talked with Councilman Blevins. Listen to this (sorry, Donnie), he did not know about the meeting until last night when "Tim Dietrick" phoned him. Then Councilman Gahan called him this morning to let him know about the meeting (no vote being taken was mentioned to him); then the City Clerk left a message on his machine (again) with no mention of a vote being taken. Donnie was assuming this was an information meeting about Stormwater. Until, Price told him it was meeting for a vote to be taken on that other ordinance that was defeated Thursday night; then his son brings in the newspaper and shows him. According to him and Mr. Kochert, the Mayor has yet to telephone them. According to Mr. Coffee, Ms. Crump won't be there. So, if the two people who ABSTAINED DID NOT BRING IT BACK TO THE TABLE, IT'S DEAD. Now, if someone is "lieing" (gosh, I hate using that word) to the taxpayers and citizens, there are no rational nor sane words I can speak at this time. Did you catch who called Councilman Blevins FIRST? C.R.A.P., boy, you nailed it to the wall. They must think we are STUPID, and me has a feeling you HAVEN'T seen anything yet.   • After retrieving the report presented to the Sewer Board LAST YEAR, that WE PAID for, the report had already identified for the Stormwater Committee all of the watersheds; all of the areas tested and where potential and existing problems would/could be found.
    Then, I find this article, thanks to my right hand, and you need to link on the CJ, Wednesday, Nov. 7, 2001 and read about the $1,000,000.00 they spent on STORM DRAINS then. The report I read mentioned an awful lot about sewers impacting some of our existing problem areas; we were told of existing sewer problems in the meeting Thursday night; and now this article. If that don't put the frosting on this cake -- I don't know what does.
    Mayor, my ? to you is this: You, the sewer board, misapplied 'TWICE' two EDIT payments of $270,000.00 each to a "BOND" (who knows what bond), for a total of $540,000.00. We asked you how you were going to pay the EDIT monies back to the inner-city maintenance fund the City established, that you MISSPENT, and you shrugged your shoulders at me. You know who I am, and I'm realllly tired. You wanted my help, supposedly, then "poof", I was a bad guy. YOU, my sir, are getting really bad advice, and that's all I have to say.

  • After much deliberation and consideration, I have reached this conclusion, hopefully standing on its own merits. If the sewer board IMMEDIATELY needs more monies (WHICH WAS MISAPPLIED to fix the work they didn't do (why we haven't heard from the EPA yet, folks); the $540,000 in EDIT funds that was misapplied and HAS TO BE PAID BACK per Council LAW; alot of the now problematic areas found last year by Mr. Gonder, Mr. Vigar & Corey Earl identified sewage as some of the potential problems areas. But yet, these are where some of "their" stormwater problems seem to be popping up. Let's see. We just said they DID NOT FIX the SEWER PROBLEM IN THE INNER CITY and now have too (immediately and durn, they spent all their monies). We just said they HAVE SHOWN BY THEIR OWN PEOPLE, helped prepared by the very people who sat on the Commitee last year whose work determined that some of the "illicit" discharge is from the lack of SANITARY SEWERS and CROSS-CONNECTIONS (sewer pipes hooked in with storm sewers), not STORMWATER. Last night, Septic Tanks had to be added back into the new ordinance because FMSM was under the impression ALL of New Albany was on sewers. EMC represented, at least twice, that he could not say that ALL houses in NA were hooked to sewers. He even identified straight pipes he knew about running over Silver Hills.

    For the good news, education was advised for alot of areas in town. This is truly a fascinating document. Looking at your watersheds, seeing companies that need help; looking and fixing erosion problems if they're causing a problem with our creeks or waterways. Helping to change our planning and zoning laws as the county did, updating them since I don't know when. It's a great environmental project/civic that ALL of NA should stand behind, and hey, volunteer to do. Thanks for letting me ramble (like you had any choice!).:)

    Let's go, I'm just getting warmed up. Got it? Just my opinion.

    I spoke with CM Blevins myself this evening, and concur with the 10;30pm commentor. Donnie told me the exact same thing. TIM DEATRICK was the first to call him and notify him about the "Special" meeting on Friday. Donnie didn't recieve word from Gahan until this morning, and didn't even know the meeting was for another vote until Steve Price called him this evening. This is NOT Donnie's fault. He had no idea what was up.
    As far as I'm concerned, the Mayor has thrown Donnie under the bus this time. Garner has laid this whole mess in Donnie's lap as being the one who wanted to change his vote. CM Blevins hasn't spoken with the Mayor, and the first he knew of the Mayor wanting to speak to HIM, was when he read it in this evenings paper.
    Shame on you Garner! You should be ashamed of how you abuse people.
    Donnie wants some answers, and by God we're going to give him answers that are FACT.
    Believe me when I say... this will indeed be a "SPECIAL" meeting. Hang on tight folks, we're goin' for a ride and it might get a little bumpy here and there, but we will reach our destination.
    Too many illegal activities have occured along the way for us to just continue to ignore.
    We will be there Friday, and we will be fighting for our rights, and for what is right.
    As for the Twerp timmy d., you're an embarassment to this city.

  • As a member of the Storm Water Advisory Committee, and I will try and restrain myself and I can only speak for myself, OUTRAGED isn't even the word you can use to describe how YOU might feel. Mr. McCormick received an invite, why not the Committee. Yes, it's public, but public can't speak. The hours spent, the monies spent gathering the doucments (truth), the discussions with Council and meetings and official Council meetings. Laura is right. Friday is going to be a bumpy ride. It should SPEAK VOLUMES. At least I know who all to call, IMMEDIATELY. Thank you blog for the information. My tribune didn't come til 5:00. That's my opinion. I feel like apologizing, but, can't find the words to even speak objectively to the WRONGNESS being perpetuated upon the taxpayers/citizens. Livid would be an understatement at this point in time.   • The Mayor has called the Tribune and I hear it's front page news; haven't got mine yet. No committee members notified; how many Council people will be able to attend; more importantly, how many TAXPAYERS can attend? Where was the Mayor when taxpayers were at Council meeting Thursday? Where was the Controller, as required by law? This is total BS.
    Maybe that C.R.A.P. article pushed him over the edge...but just because they have 8 salaries coming out of our "sewer" slush fund that should not have been -- in order to circumvent the General Fund -- do I feel sorry for them? H*** no; do I feel taxpayers should get kicked because of it? H*** no; do I feel Garner should have known about this at LEAST last year; rather than almost 3 years into his term? H*** yes!
    How many taxpayers do you think can attend this meeting? How many Commitee people do you think don't work and who haven't been notified? It's not like this issue wasn't called out at Budget Hearings. I AM TIRED OF THE BS. IT'S OUR MONEY, what part of that do they NOT UNDERSTAND????? BS

  • Unfortunately, No, Taxpayers can not speak on Friday, unless Garner SAYS THEY CAN. To me, the issue died on the floor, 4 nos, 2 abstentions, and 3 yeas. The two that abstained claim they are not bringing it back up. To me, this thing is dead and this is nothing but a sham. Have seen alot of things die on a 5-4 vote; and they never came back to haunt us. IT'S B.S. Garner cannot stand the monies were found until the Storm Water Committee can get it on the tax rolls, so it's fair. TO ALL TAXPAYERS, YOU CAN SUE OVER THIS IF IT'S PASSED, BECAUSE THEY WILL NOT BE ABLE TO CAPTURE VACANT PROPERTY, AND YOU CANNOT HAVE A LAW THAT ONLY TAXES CERTAIN INDIVIDUALS AND NOT ALL. Please, somebody, remember that. That TIF money was meant for that; that's one of the reasons the General Fund is so short, etc. TAXPAYERS SHOULD NOT HAVE TO PAY TWICE FOR GARNER'S LACK OF CONTROL OF THE SEWERS AND HIS FINANCIALS.     and 30.23 F&G.

  • Tell them, Concern Taxpayer and East Ender, tell 'em how it is. Someone is suppose to protect us from them holding an illegal meeting on taxpayers. Having heard what I've heard today, the people in NA are getting ready to learn the hard way, or should I say in a way they don't want to know, as to what is REALLY UP FRIDAY.
    Tribune, commend you on your scoop on the sewer vandalism article. Did you take that nice long walk back behind the Hampton Inn and figure out a way to cross the creek (without getting mud up to your knees and wading through waste & water sometimes waist high) enabling you to see what looks like "Old Faithful" at times? In My Opinion, I Find That Too Coincidental That Vandals Played A Role Here, my opinion. Having been told by media that stories about sewers, etc... aren't sexy enough for readers; how does one scam after the other?

    This blog is going to turn into being one of the most wonderful thing/tool that has happened in NA for a long time. The information will flow freely; and so will it's ideas -- whatever they may be. It will enable the people, its Citizens, to voice and not fear the retaliation so selectively enforced in the past, and presently.
    The smoke screens went up today, but that's okay -- it's simply smoke & mirrors. Where's the real fire? Glad you asked! In the sewers' financials. Who is Chairman of the Sewer Board, the Mayor.   • the bad news is when the City Clerk didn't mail written notices or hand deliver them in writing to my council man, instead of calling them on their cell phones, this meeting is not legal. There are two other issues, but Laura named them.
    And how does anyone know if public can speak if no agenda was mailed and a councilman thought this was simply a stormwater "discussion"? Keep on diggin. Wake up and smell the coffee NA. Usually don't drink it after noon, it may be required by 3.....

  • City Code states that if a council member has intentions to change their vote to the "MAJORITY" vote (4 nay), they may bring this issue before the NEXT REGULAR scheduled Council meeting and it should proceed any other business on the agenda. No SPECIAL meeting shall be called.
    Furthermore, the Clerk is mandated by Code to notify Council members in writing either in person or delivered to their homes. NOT calls on the phone.
